Because we have specific laws dealing with foreign diplomats and their families.  Those born under them have optional LPR qualifications.

Are you willing to grant illegals the same immunity from our laws as diplomats?  Their children born here LPR status?

The language in the 14th is clear and true constitutionalist SC Justice say in the mold of Scalia isn't going vote against it, the SOH also understands this as evidenced by his remarks the other day.

So why did they pass a special law for Native American's?

Let's face it the equal protection law is probably one of the most often broken of the Amendments.

indians were not "under the jurisdiction" as described under the 14th as they were sovereign nations just like the children of diplomats are not therefore their children are not.
