A driver is under the influence when his or her ability to operate a motor vehicle is impaired. A person's ability to operate a motor vehicle is impaired if he or she is less able to safely control the vehicle because of the consumption of alcohol or controlled substances. This means that if a police officer pulls you over and determines that you are impaired by alcohol and/or any other drug, you could be arrested and prosecuted, regardless of your BAC. Do counties in all states collect this data in the same way? Anecdotally people in WI drink and don't give a shit who knows about it. I've worked all over the place. People are drinking everywhere and in every state I have ever been in and I just don't see a lot of stark contrasts. Whether the data is accurate or not it seems Wisconsinites can drink and drive without getting themselves killed as often. Fatal car accidents seem far more prevalent in states with fewer drinkers (at least according to their stats anyway). And don't tell me that it's because WI is mostly rural when states like Montana and N and S Dakota have far higher rates. Only a blood sample or a breathalyzer test can prove blood alcohol level. I got charged with driving under the influence 30 or so years ago. It was a $50. fine.
