For a first-offense DUI in California, consequences for conviction generally include three years of informal probation, fines of $390 plus “penalty assessments” (totally approximately $2000, and completing a first offender alcohol program that consists of a 30-hour class, at a cost of about $500.

 

 

Why wont you acknowledge that he hit somebody so its not the same charge??

NPR says the charge of driving under the influence and causing injury was dismissed

The county DA released this yesterday......

"Judge Solga accepted plea forms from Mr. Pelosi’s privately retained defense counsel, Amanda Bevins. The plea forms were signed by Paul Pelosi in front of his attorney. Mr. Pelosi pled guilty to Driving Under the Influence of Alcohol Causing Injury. Based upon the plea, Judge Solga dismissed the second charge of Driving With .08% Blood Alcohol Level or Higher Causing Injury in the interests of justice. Judge Solga found that defendant’s plea was freely and voluntarily entered, there was a factual basis for said plea, and that the defendant made an intelligent waiver of his rights.

Judge Solga sentenced Mr. Pelosi to the following consequences: (1) placed on summary probation for 3 years; (2) pay a $1723 court fine; (3) serve 5 days in jail; (4) submit to a blood, breath, or urine test if requested by any law enforcement officer or probation officer if suspected of driving with a measurable amount of alcohol; (5) pay $4927.53 in victim restitution for medical bills and lost wages as well as a standard $150 restitution fine; (6) do not operate a motor vehicle with a measurable amount of alcohol; (7) immediately enroll in, pay for, and successfully complete a licensed DUI program for 3 months; (8) do not operate a motor vehicle unless it is equipped with a functioning, certified ignition device for 1 year. Based upon this conviction, the Department of Motor Vehicles can suspend Mr. Pelosi’s driver’s license for one year. The Court will retain jurisdiction for any future restitution bills"

I got a buddy who still has to report with a breathalyzer to his PO.

We were sledding in NEK and couple times in the day he has to drive around looking to find cell service just to check in  ...fuckin sucks 😂

SAN FRANCISCO (AP) — The husband of U.S. House Speaker Nancy Pelosi pleaded guilty Tuesday to misdemeanor driving under the influence charges related to a May crash in California's wine country and was sentenced to five days in jail and three years of probation.

Paul Pelosi already served two days in jail and received good conduct credit for two other days, Napa County Superior Court Judge Joseph Solga said. Paul Pelosi will work eight hours in the court's work program in lieu of the remaining day, Solga said during Paul Pelosi's sentencing, which he did not attend.

State law allows for DUI misdemeanor defendants to appear through their attorney unless ordered otherwise by the court.

As part of his probation, Paul Pelosi will also be required to attend a three-month drinking driver class, and install an ignition interlock device, where the driver has to provide a breath sample before the engine will start. He will also have to pay about $5,000 in victim restitution for medical bills and lost wages and nearly $2,000 in fines, the judge said.

Paul Pelosi was arrested following a May 28 crash in Napa County, north of San Francisco, after a DUI test showed he had a blood alcohol content of .082%, just over the legal limit.

Officers responding to the crash after 10 p.m. near the wine country town of Yountville said they found Pelosi in the driver’s seat of a 2021 Porsche Carrera and the other driver standing outside a sport utility vehicle, according to the complaint.

California Highway Patrol officers reported that Pelosi was “unsteady on his feet, his speech was slurred, and he had a strong odor of an alcoholic beverage.”

Pelosi offered to officers his driver’s license along with an “11-99 Foundation” card when asked for identification, the complaint says. The 11-99 Foundation supports CHP employees and their families.

Prosecutors filed the case as a misdemeanor because of injuries to the 48-year-old driver of the SUV. They have declined to identify the driver, saying the person has requested privacy.

In an interview with investigators from the district attorney’s office, the driver reported pain in his upper right arm, right shoulder and neck the day after the crash. He said he also had headaches.

Pelosi was released on $5,000 bail after his arrest.

Speaker Pelosi was in Rhode Island to deliver the commencement address at Brown University at the time. Her office did not immediately respond to a request for comment Tuesday.

Seems like the sentence fits the crime. I don’t know of anyone that got two years in prison for owi with injury. Maybe in matters of owi with great bodily harm  But that’s even stretching it. Possible if it was for multiple owi.

12.5 YEARS for Felony OWI with Injury in Wisconsin

However, every OWI causing great bodily harm conviction carries the same penalty: a Class F felony charge. You could go to prison for 12.5 years and have to pay a $25,000 fine. The only drunk driving charge more serious than an OWI causing great bodily harm is Vehicular Manslaughter while Intoxicated. And it all hinges on whether or not the injuries were "serious."

The guy did 5 hours of jail time. You think you would get 5hours if you had a few to many and got pulled over in the free candy van?

In Wisconsin it’s rare that it’s that long. Unless of course you’ve got a bac above a .30 and then they’ll hold you for your own safety. You’re processed and released to a responsible driver usually within 2 hours. It migh be different in his state.

Prison or jail time Is set by the judge. 12 years is max.

In Wisconsin probation is rarely ordered on 3rd offense. 1st offense is still considered a civil violation. 2nd offense typically results in 5 days county jail or house arrest with Huber privileges (work release).

In the end I don't see this as exceptional preferential treatment.   I call them like I see them.  

correct. some see the pelosi name and want blood. that's understandable in today's political environment. but a felony conviction in this case is preposterous.
