It appears you don't understand that that rule applied only to slaves, hence the wording 'Free people" the reason Indians weren't to be counted was because they were tax exempt. It is laid out very clearly who is to be counted, the 3/5ths dealt with slaves and has no relevance today as we have no legal slavery.
