Well I'm lost. I thought  amnesty was used by a few diff presidents.

An "equally divided" U.S. Supreme Court affirmed a lower court ruling that said President Obama exceeded his authority with his executive amnesty for illegal aliens. It's an important victory for the rule of law and separation of powers.

Acting more like a dictator than an elected official, Obama had decreed that 4.3 million illegals who, under U.S. law, were subject to deportation, could suddenly be gifted with something called "lawful presence" simply by applying to stay under a program that Obama created out of thin air.

In essence, Obama sought to rewrite existing law by executive fiat, claiming his program was merely "deferred action" -- not breaking the law.

This plainly illegal move had already been rejected in early 2015, when U.S. District Judge Andrew Hanen issued a temporary injunction against the Obama amnesty, in effect calling it illegal. The White House appealed to the Fifth Circuit Court of Appeals in New Orleans. But in a 2-1 decision, it upheld Hanen, calling deferred action "much more than nonenforcement."

"It would affirmatively confer 'lawful presence' and associated benefits on a class of unlawfully present aliens," the Fifth Circuit majority decision said. "Though revocable, that change in designation would trigger ... eligibility for federal benefits ... and state benefits -- for example, driver's licenses and unemployment insurance -- that would not otherwise be available to illegal aliens."

 

In short, Obama's amnesty walked all over laws passed by Congress and signed into law by previous presidents -- the established law of the land.

Though it was a Texas judge who struck it down, Texas wasn't the only state to recognize the illegality of Obama's move. Indeed, 25 other states sued to halt the so-called Deferred Action for Parents of Americans program, which Obama created out of nothing in 2012 and then expanded in 2014, without congressional authorization.

On Thursday, the U.S. Supreme Court let the decision stand -- in effect, killing what foes had come to call "Obamnesty."

Elizabeth Slattery and Hans von Spakovsky, writing at the Heritage Foundation's Daily Signal blog site, called it a "victory for the separation of powers and limited government."

That's exactly correct. Going a step further, we would say this was a victory over the growing tendency of liberal presidents to assume powers they don't have under the Constitution, then daring the courts and the people to try to stop them. Whether you believe we should grant amnesty to illegals or not, this was an illegal act on its face -- all Americans should oppose such illegal acts, even if they agree with them in principle.

Some commentaries noted that the court's ruling will raise the issue of immigration even further during the coming election campaign. Well, good. That's where it belongs. We elect a president, not a king.

As the Founders said, we live in a nation of laws and not men. Sadly, it's a lesson that must be relearned each generation for us to keep our precious freedoms.

While much attention has been given to the fact that President Ronald Reagan granted amnesty to illegal aliens in 1986, none is ever given to the multitude of amnesty measures which President Bill Clinton signed into law.

The following is a list of amnesties granted to illegal aliens by President Clinton:

-In 1994, an amnesty for illegal aliens (Section 245 (i)) was added to the FY 1995 Commerce, Justice, State Appropriations bill. The rolling amnesty ended on September 30, 1997, and resulted in 578,000 illegal aliens being granted permanent legal status.

– The Nicaraguan Adjustment and Central American Relief Act (NACARA) Amnesty of 1997, granted amnesty to 1,000,000 illegal aliens from Central America.

-The Haitian Refugee Immigration Fairness Act Amnesty (HRIFA) of 1998, granted amnesty to 125,000 illegal aliens from Haiti.

– In 2000, amnesty was granted to about 400,000 illegal aliens who claimed they should have been amnestied, but were not under the Immigration Reform and Control Act of 1986.

-Legal Immigration Family Equity (LIFE) Act Amnesty of 2000 removed deportation orders and/or granted permanent legal residency to an estimated 900,000 illegal aliens.

While it is never reported on, nor spoken of in today’s ongoing debate on illegal immigration, Bill Clinton granted amnesty to at least 3,000,000 illegal aliens and with his actions–undoubtedly encouraged millions more to enter the U.S. illegally.

Democratic presidential hopeful Hillary Rodham Clinton vowed Tuesday that if elected, she would try to expand President Obama’s deportation amnesty to more illegal immigrants, saying this administration has left out a number of aliens who deserve to be granted legal status.

Speaking in Las Vegas at a Cinco de Mayo meeting focused on immigration, Mrs. Clinton also called for granting attorneys to illegal immigrants facing the complex immigration system, and said she would like to re-examine detention to ensure more illegal immigrants are released as they await deportation.

Mrs. Clinton delivered on just about every question from immigrant rights activists, who had been pressing her to reject Mr. Obama’s detention policies and go beyond his amnesty.
