Trump Pardons 9 Diesel Tuners Charged with Deleting Emissions Equipment

  • Gold Donating Member

resident Trump pardoned a diesel mechanic convicted of violating the Clean Air Act back in November, and now, he’s done it again. On the eve of Independence Day, the commander-in-chief granted clemency to more than half a dozen individuals who had previously been dealt prison sentences, hefty civil penalties, and serious criminal fines. It’s the latest development in what can only be described as an about-face regarding the federal government’s stance on environmental enforcement.

The president said during an Oval Office news conference that these cases came to his attention “because [he] noticed they were arresting people for fixing their car.” He later added, “We rule by common sense.”

Good. EPA and their massive overreach being clipped is awesome. These charges were gestapo level bullshit by "warmer" fanatics.

The EPA somehow walked their way into being a legislative body. They are not. And anything and everything that was made "law" at their whim should be struck back and down. Period.

The Wyoming diesel tuner who was imprisoned after being convicted on hundreds of counts of violating EPA emissions regulations received an unconditional pardon from President Trump last week. Troy Lake, the operator of Elite Diesel near Cheyenne, was originally sentenced to one year and one day in prison and fined $52,000 after being found guilty on more than 300 counts of disabling emissions devices in diesel pickups. He has been on house arrest since September.

Government overreach.

They should pardon people that haven't been charged with anything. Nothing fishy at all about that. And pardon his sons too!!!!!

Let's not fix the law but instead just let people off.

Yes, this makes more sense than continuing to punish people who were clearly being made examples of by an overzealous, and ILLEGAL law body of the government. I mean, we can wait years to repeal the law if ever. DC is broken and flooded with traitors and an opposition party.

Some laws are made to be defied. Some broken. It depends on the Constitution. Both sides strip rights away. NOBODY more than the Dems though. Worthless filth.

Any that were drawn up and pushed through on EPA guidelines is a start. Also, the ATF. Both are the biggest violators of our rights outside of the IRS, which operate completely in defiance of the Constitution. And how interesting is it they all operate on tax and fine revenues.

Did congress write, and vote to codify the law he was convicted of breaking, or was it a bureaucrat(s)?

how far back do you want to go? ever wonder who formed the EPA in the first place?

Diesel emissions laws began with the U.S. Environmental Protection Agency (.gov) and the 1970 Clean Air Act. The laws evolved over five decades from basic smog checks to the near-total elimination of particulate matter (PM) and nitrogen oxides (NOx) through ultra-low sulfur diesel fuel and advanced exhaust aftertreatment systems.Key Milestones in Diesel Emissions Regulations

1970: The U.S. Environmental Protection Agency (.gov) is established, paving the way for the first on-road diesel engine standards.

1974: First EPA standards go into effect, targeting carbon monoxide (CO), hydrocarbons (HC), and nitrogen oxides (NOx).1988: PM (soot) is officially regulated for the first time.

1991–1998: The EPA introduces progressive "Tier" standards for non-road engines and heavily restricts PM limits for on-road heavy-duty trucks.

1998 Consent Decrees: The EPA penalizes seven major diesel engine manufacturers for using "defeat devices" that secretly disabled emissions controls during highway cruising. This resulted in an agreement to meet future 2004 standards ahead of schedule.

2006: A massive mandate takes effect requiring refiners to slash diesel sulfur content from 500 ppm to 15 ppm (Ultra-Low Sulfur Diesel).

2007–2010: The EPA enforces stringent "US 2010 Standards". This requires the addition of Diesel Particulate Filters (DPF) and Selective Catalytic Reduction (SCR) technology using Diesel Exhaust Fluid (DEF).

2015: Final phase-in of the EPA's Tier 4 non-road standards is completed, achieving a 90% reduction in particulate and NOx emissions compared to older non-road engines.

imo, 2015 was the step too far but wtf do I know about any of this stuff? sarcasm1

The EPA is not a legislative body and therefore has no rights or regulations to enforce ANYTHING unless it goes through the legislative process. They have been allowed to overstep their bounds and infringe on Constitutional rights. Don't even get me started on the fucking CDC either. Time to clip these wings...that ironically seem to grow bigger and stronger under big government Dem policies.

And November? Is that when it's going down? Don't tease me!

Congress passes environmental statutes (like the Clean Air Act and Clean Water Act) and grants the EPA the legal authority to create specific, enforceable regulations, which are codified in the Code of Federal Regulations.

The EPA and authorized states enforce these rules using various Enforcement Tools:

Compliance Monitoring: The EPA inspects facilities, reviews reports, and investigates potential infractions.

Administrative Actions: The EPA issues formal notices of violation, compliance orders, and assesses civil penalties. These Civil Penalties are adjusted annually for inflation.

Judicial & Criminal Actions: For severe violations, the EPA refers cases to the U.S. Department of Justice to file lawsuits or pursue criminal prosecution in federal court.

Congressional Oversight: Congressional committees, such as the House Energy and Commerce Committee and the Senate Environment and Public Works Committee, continuously monitor the EPA’s regulatory and enforcement activities to ensure the agency follows legislative intent.

It’s obvious that the states can’t be trusted to regulate pollution. At the same time the EPA needs some checks and balances. Congress is in no way capable of making decisions about necessary environmental laws. At the same time there needs to be better overreach protection. The mechanisms are in place, but politicians are too busy trying to stay in power for them to do their jobs. Instead we end up with the auto makers having to use methods to increase mpg and decrease emissions when that technology doesn’t exist on a practical level.

He didn't bypass laws. He has the right to pardon. AND AGAIN...pardoning bullshit, overzealous charges from an agency that has been given way to much sway and power that isn't a legislative branch. "Making an example of people" is a fascist agenda. Also, see, CDC and "choices".
