The Source of the Data

The Just Facts report relies on a 2014 study by Dr. Jesse Richman. Here is how that study is viewed today:

* The Original Claim: Richman’s 2014 paper estimated that a significant percentage of non-citizens were registered and voting.

* The Rebuttal: Peer-reviewed responses from other scholars argued that the data was flawed due to "measurement error." Specifically, they found that a small number of citizens accidentally checked the "non-citizen" box on surveys. Because non-citizens are such a small group, even a tiny number of citizens making this mistake can make it look like "non-citizens" are voting in huge numbers.

* The Author's Stance: Dr. Richman himself has pushed back against his work being used to claim "massive voter fraud." In more recent court reports, he has provided much lower estimates (around 1%) to ensure the data is robust for legal cross-examination.

What Independent Audits Say

When states perform actual audits of their voter rolls rather than using survey estimates, they consistently find that non-citizen registration is exceedingly rare:

* Georgia (2022): An audit found that 1,634 non-citizens attempted to register over a 25-year period, but none actually cast a ballot because they were caught by the system.

* Brennan Center Study: An analysis of 23.5 million votes across 42 jurisdictions found only 30 suspected cases of non-citizens voting.

* The Heritage Foundation: Even the conservative Heritage Foundation’s Election Fraud Database, which tracks proven cases of fraud, lists only 77 instances of non-citizens voting between 1999 and 2023.

Alternative Ratings: Media bias trackers, such as AllSides, often rate PolitiFact's editorial stance as "Left-Center". 

But even they state that they found 30 cases out of only 42 districts.
