I always thought that, but I know a fellow who recently was charged with over .080 and Impaired on his boat.  He lost neither his PCOC nor his DL for 3 months, as you would in a car. 

Is the 3 month automatic suspension not applicable to vessels, and not connected to your DL?  Perhaps only upon conviction are they tied together?  Thanks!

Being impaired and operating a vessel is the same as driving your car impaired.  Same penalties and loss of drivers licence.  Its a criminal code offence.

He should've lost his dl for the 90 days...based on two tests of over .080.  There is no mechanism in place to suspend the PCOC.  Upon conviction he/she may be prohibited from operating a vessel as well as a vehicle.

Yes, you need both tests .080 or above fo the 90 day amdinistrative drivers licence suspension to kick in.

Interesting, never knew that.  So 2 tests over .080 for the 3 month suspension, but only one is required to lay an over .080 charge?

Nope, but one of the Alex Bay American Poker runners did last Sunday, and he got fined, so it got me wondering if the laws were the same on our side. LOL

Sean, marine question.

What is required to legally construct a roped-off swimming area on a lake?  Someone has recently installed one at one of our common anchorage spots.  Wouldn't the CHS have to be notified to update their charts?  And who has jurisdiction over such constructs - municipality, etc.?

I'd have to think that somebody installing one of these with no authorization is creating a marine navigation hazard.

I agree with you.  I'd think right off the bat MNR would be very interested.  I know the towns has some say but MNR and MOE always have final say.  Transport Canada would be interested from a navigational perspective as well.

I haven't seen it yet, but apparently it's so wide that no boats can get in.  Clearly we were having too much fun there.  :)

Which brings another question - we have a few stereos onboard that belt it out pretty good.  (we run generators, etc.).  Is there actual legislation against noise during daylight hours?  I always figured 07:00 to 23:00, noise was kinda off the legal grid.  Municipal bylaws notwithstanding, of course. 

BTW, are you boating this year?

BTW, are you boating this year? 

The only real noise legislation on the water revolves around mufflers/exhaust.  As you suggested within city limits their bylaws or around provincial parks, federal parks (lock stations and various islands)  would apply but beyond that I can't think of any other legislation.

 

Not boating (off duty) yet...sigh...  been one of those years where everything that can go wrong or work against you has...  Will keep you posted tho!!!

Guess I jinxed it by bringing up the ATV's.  My boys got stopped by an OPP officer on their way home from doing farm work yesterday. The officer was fair and understanding of the situation though.  Escorted them home and gave my wife a blast of shit but no charges laid.  He's ok in my books, lol.

Glad that turned out ok!!!   We're not all assholes....  (despite what Zoso would have you believe)

Just a guy doing his job.  I'm glad they boys got to have a positive experience for their first time dealing with the law.  IMO a negative experience at an early age can adversely affect ones outlook on law enforcement.  Officer told mom they were very polite when he stopped them.

Lol.  I think you guys are mostly digital now anyway?  I received a warning a couple weeks ago on the Gardiner-digitally printed in the cops car, looks just like a ticket.  He CLAIMED he saw my car making agressive lane changes...... :)

I'd say about 75% are digital with e-ticketing and computers on board.  That climbs to about 99% in the GTA.  Most of us have an app on our phones with all the statutes, criminal code etc...  has fines, wordings, demerit point levels.  Designed and built by a couple coppers...  works great...available off-line as well.  I think its about $15 for 2yr subscription.

Hey Sean. A multi part question I have never seen talked about here. When a sled has a rider with a G1 they can drive a sled on and across a road. Is it the same for an ATV? What about a SXS or an ATV with a passenger? If so it seems odd that a G1 Driver can drive one of the 4-5 passenger SXS's on a road without a "G" passenger. 

Just saw a SXS go by with 4 kids and was kinda shocked. Does the G1 operator not need a full G passenger to drive on a road like in a car? Seeing 4 kids in a SXS heading into the bush in shorts and t-shirts with no helmets struck a nerve with me. Awaiting for the pager to go off for a Rescue, as a first responder.

They need a G2 to drive am ATV or SXS on the road.  They can't legally drive a SXS with a G passenger.  I asked this question before.
