Tom Brady Tosses Legal Hail Mary

The Patriots quarterback will appeal his four-game Deflategate suspension, former U.S. Solicitor General Theodore Olson told Good Morning America Monday. Brady’s legal team, led by Olson, will file an “en banc appeal” to the U.S. Court of Appeals for the Second Circuit, asking them to review their three-judge panel’s previous decision, handed down in April.

“The facts here are so drastic, and so apparent, that the court should rehear it,” Olson told GMA.

 

Seven of the Second Circuit’s 13 judges must agree that Brady’s en banc appeal has merit before the full roster of active judges will hear the case, a review that typically takes four to six weeks. Brady’s four-game suspension will be stayed if he receives an en banc hearing, which are notoriously hard to come by in the Second Circuit—less than .03-percent of cases received one between 2000 and 2010, as Ben Volin notes.

 

Brady’s legal team says the 38-year-old has been enjoying a “low-key offseason” with his family, but for now “has to sit back and await his fate for this season.”

I agree...it would not have mattered if Brady used Nerf footballs....they were going to kick the crap out of the Colts that day...but...Brady lied about the whole thing (probably because he has to?)  it's always the lying that gets you in trouble...

either way, I am tired of hearing about this crap....someone on either side needs to let it go....

NFL Commissioner Roger Goodell says he sees no avenue right now for a settlement with Tom Brady as the star Patriots quarterback appeals his four-game "Deflategate" suspension.

Goodell told reporters Monday that the league will move forward based on whether the 2nd U.S. Circuit Court of Appeals decides to grant Brady's request for the full court to re-hear the case. A three-judge panel from the appeals court in April reinstated Brady's punishment for his role in using underinflated footballs during the 2015 AFC championship game.

The type of appeal Brady is seeking is rarely granted.

Goodell spoke before Bills great Jim Kelly's 30th annual charity golf tournament outside of Buffalo.

Goodell says he was right to discipline Brady under powers granted the commissioner by the collective bargaining agreement with players. He says it's important for the commissioner to be responsible for matters involving the integrity and competitiveness of games.
