State Department tried to bribe FBI to unclassify Clinton e-mails

WASHINGTON — Undersecretary of State Patrick Kennedy pressured the FBI to declassify certain emails from Hillary Clinton’s private server that were previously deemed classified, according to FBI documents released Monday.

In the documents, an unnamed person interviewed by the FBI said Kennedy contacted the FBI to ask for the change in classification in return for a ‘quid pro quo.’” “In exchange for marking the email unclassified, STATE would reciprocate by allowing the FBI to place more agents in countries where they are presumably forbidden,” the documents said.

During a later meeting with the FBI, CIA and other agencies, Kennedy was asked whether any of the emails in question were classified. “Well, we’ll see,” Kennedy responded.

The FBI on Monday released 100 more pages from its now-closed investigation into whether the Democratic presidential nominee mishandled sensitive government information.

Whether Clinton sent classified emails from her private server that could have jeopardized national security has become a key issue ahead of the presidential election.

FBI confirms: Officials discussed deal to cover up Clinton emails

 

Newly released documents from the FBI's year-long investigation of Hillary Clinton's server indicate officials discussed a deal in which the FBI considered declassifying some of the classified emails that were found, if the State Department could agree to boosting the FBI's presence in Iraq.

FBI notes released Monday show that Patrick Kennedy, State's undersecretary for management, pressured the FBI to change the classified markings on an email that had been upgraded to "secret."

One section of the notes indicates that Kennedy wanted a classification change to "B9," and said that change would allow him to "archive the document in the basement of DOS never to be seen again."

The notes then indicate that another unnamed official said he would "look into the e-mail matter if KENNEDY would provide authority concerning the FBI's request to increase its personnel in Iraq."

Another section of the FBI's notes shows that Kennedy "was attempting to influence" the FBI's classification of documents found on Clinton's emails, and asked if the FBI would "see their way to marking the email unclassified."

A third section of the notes say that an unnamed official "believes STATE has an agenda which involves minimizing the classified nature of the CLINTON emails in order to protect STATE interests and those of CLINTON."

The FBI said in a statement that no quid pro quo took place, and that the email in question remained classified at the "secret" level. The bureau also said the unnamed official who requested Kennedy's help securing additional personnel in Iraq has since retired.

Still, the findings are the latest sign that the State Department was coordinating with the Clinton campaign to downplay the impact of the classified information found on Clinton's emails, after Clinton had said for months that she never emailed any classified data on her personal email system. An email leaked last week appears to indicate that the State Department was working to massage the email story by working with reporters to downplay it.

A 189-page FBI report released late last month hinted at Kennedy's role in suppressing efforts to classify Benghazi-related emails.

One interesting revelation in the document came from an interview with an unnamed individual, who suggested that Freedom of Information Act requests related to Clinton went through a group sometimes called "the Shadow Government."

"There was a powerful group of very high-ranking STATE officials that some referred to as 'The 7th Floor Group' or 'The Shadow Government.' This group met every Wednesday afternoon to discuss the FOIA process, Congressional records, and everything CLINTON-related to FOIA/Congressional inquiries," the FBI's interview summary said.

"But another interview contained in the same collection said that though Kennedy reached out to FBI about declassifying the email, it was the FBI that brought up getting agents stationed in Iraq.
That FBI employee said he personally spoke with Kennedy about the email, and that he suggested he would look into it if Kennedy "would provide authority concerning the FBI's request to increase its personnel in Iraq."
The dispute was over an email that State determined to be unclassified, but in inter-agency review, the FBI said contained classified information.
State said the email was released in May 2015 as part of its Freedom of Information Act disclosure. The email, from November 18, 2012, was about possible arrests related to the Benghazi attacks.
Both FBI and State on Monday denied any "quid pro quo."
 
"The FBI determined that one such email was classified at the Secret level," FBI said Monday in a statement. "A senior State Department official requested the FBI re-review that email to determine whether it was in fact classified or whether it might be protected from release under a different FOIA exemption. A now-retired FBI official, who was not part of the subsequent Clinton investigation, told the State Department official that they would look into the matter. Having been previously unsuccessful in attempts to speak with the senior State official, during the same conversation, the FBI official asked the State Department official if they would address a pending, unaddressed FBI request for space for additional FBI employees assigned abroad."
